Please read these terms and conditions carefully before using Our Service.
Interpretation and Definitions
Interpretation
The words whose initial letters are capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.
Definitions
For the purposes of these Terms and Conditions:
Affiliate means an entity that controls, is controlled by, or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.
Country refers to: Portugal
Company (referred to as either "the Company", "We", "Us" or "Our") refers to NOT NPC.
Device means any device that can access the Service such as a computer, a cell phone or a digital tablet.
Feedback means feedback, innovations or suggestions sent by You regarding the attributes, performance or features of our Service.
Paddle refers to Paddle.com Market Limited, the authorized reseller and Merchant of Record for all NOT NPC subscription payments.
Service refers to the Website.
Subscriptions refer to the services or access to the Service offered on a subscription basis by the Company to You.
Terms and Conditions (also referred to as "Terms") means these Terms and Conditions governing Your access to and use of the Service.
Website refers to NOT NPC, accessible from https://www.notnpc.com/
You means the individual accessing or using the Service.
1. Acceptance of Terms
By accessing or using notnpc.com, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree, you may not use the Service.
You represent that you are at least 18 years of age. The Company does not permit those under 18 to use the Service.
Your use of the Service is also subject to Our Privacy Policy.
2. Membership & Subscriptions
Subscription Plans
Access to certain parts of the Service — including the full Codex (Rules IV–X), Discord community, and member events — requires a paid Subscription. Subscriptions are billed on a recurring monthly basis.
At the end of each billing period, Your Subscription will automatically renew under the same conditions unless You cancel it.
Payment Processing — Paddle
All payments are processed by Paddle.com Market Limited ("Paddle"), which acts as the Merchant of Record for all transactions. When you purchase a Subscription, you are transacting directly with Paddle. Paddle is responsible for billing, invoicing, and payment processing. For billing-related inquiries, you may contact Paddle support or reach us at hello@notnpc.com.
Billing
You shall provide accurate and complete billing information. Should automatic billing fail, an electronic invoice will be issued for manual payment within the specified deadline.
Fee Changes
We may modify Subscription fees at any time. Fee changes take effect at the end of the current billing period. We will provide reasonable prior notice of any changes. Continued use of the Service after the change constitutes your agreement to the new fees.
Subscription Cancellation
You may cancel your Subscription at any time through your billing portal or by contacting us at hello@notnpc.com. You will retain access until the end of the current billing period. No further charges will be made after cancellation.
3. Refund Policy
If you are subscribing for the first time, you may request a full refund within 7 days of your initial payment by contacting hello@notnpc.com. After 7 days, subscription payments are non-refundable.
Subsequent renewal charges are non-refundable. In exceptional circumstances — such as duplicate charges or technical errors — refund requests may be reviewed on a case-by-case basis at our sole discretion.
Initiating a chargeback without first contacting us may result in immediate suspension of your membership.
4. Content Access
The Codex
Rules I–III of the NOT NPC Codex are publicly accessible without a subscription. Rules IV–X are available exclusively to members on the Player tier and above.
Discord Community
Access to the NOT NPC private Discord server is granted upon active Subscription. Access is revoked upon cancellation or non-payment. You may not share your Discord access with non-members.
Membership Tiers
Different subscription tiers grant different levels of access. Details of each tier's benefits are described on the Membership page at notnpc.com/membership.
5. Prohibited Conduct
By using the Service, you agree not to:
— Share your membership access, login credentials, or Discord access with any non-member; — Harass, threaten, or abuse other members or staff; — Use the Service for any unlawful purpose; — Attempt to reverse-engineer, scrape, or disrupt the Service; — Impersonate any person or entity in connection with the Service.
Violation of these rules may result in immediate termination of your membership without refund.
6. Intellectual Property
The Service and its original content, features, and functionality — including the NOT NPC name, Codex, visual design, and trademarks — are and will remain the exclusive property of the Company. Our trademarks may not be used without prior written consent.
7. Your Feedback
You assign all rights in any Feedback you provide to the Company. If such assignment is ineffective, you grant the Company a non-exclusive, perpetual, royalty-free license to use such Feedback without restriction.
8. Promotions
Any promotions, contests, or sweepstakes offered through the Service may be governed by separate rules. If those rules conflict with these Terms, the promotion rules apply.
9. Links to Third-Party Websites
The Service may contain links to third-party websites. The Company has no control over and assumes no responsibility for the content or practices of any third-party sites. We strongly advise you to read their terms and privacy policies.
10. Termination
We may terminate or suspend your access immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the Service ceases immediately.
11. Limitation of Liability
To the maximum extent permitted by applicable law, the Company's total liability shall be limited to the amount you paid through the Service in the 12 months preceding the claim, or 100 USD if you have not made any payment.
The Company shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
12. "AS IS" Disclaimer
The Service is provided "AS IS" and "AS AVAILABLE" without warranty of any kind. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
13. Governing Law
These Terms are governed by the laws of Portugal. Any disputes shall first be attempted to be resolved informally by contacting the Company.
For European Union (EU) Users
If you are a European Union consumer, you benefit from the mandatory provisions of the law of your country of residence.
United States Federal Government End Use Provisions
If You are a U.S. federal government end user, our Service is a "Commercial Item" as that term is defined at 48 C.F.R. §2.101.
United States Legal Compliance
You represent and warrant that (i) You are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a "terrorist supporting" country, and (ii) You are not listed on any United States government list of prohibited or restricted parties.
14. Severability and Waiver
If any provision of these Terms is found unenforceable, it will be modified to the minimum extent necessary. The remaining provisions continue in full force. Failure to enforce any right does not constitute a waiver of that right.
15. Changes to These Terms
We reserve the right to modify these Terms at any time. Material changes will be notified at least 30 days in advance. Continued use of the Service after revisions constitutes acceptance of the new Terms.
